1. Agreement
These Terms of Service (“Terms”) govern your access to and use of plantivoai.com and the PlantivoAI platform (the “Service”). The Service is operated by Bigpixel Maciej Nowakowski, NIP 659 153 01 34(“we,” “us,” or “our”). By creating an account, requesting access, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
PlantivoAI is an AI-powered garden design platform. Depending on availability and your credit balance, you may upload garden photos, set design preferences, optionally mark areas to edit, generate AI-assisted landscape visualizations and planting suggestions, browse your design history, and share designs via links. We may update, improve, or discontinue features at any time. We do not guarantee that outputs will be suitable for every climate, soil condition, or local regulation.
3. Eligibility & Access
You must be at least 16 years old to use the Service. Registration may be limited or invite-only (for example via a join-interest list). By registering or requesting access, you represent that you meet the age requirement and that the information you provide is accurate and complete.
4. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at support@plantivoai.com if you suspect unauthorized access.
5. Acceptable Use
You agree not to:
- Upload content you do not have the right to use or distribute
- Upload unlawful, harmful, or infringing material
- Attempt to disrupt, reverse engineer, scrape, or overload the Service
- Circumvent credit limits, quotas, or access controls
- Use the Service to generate misleading, harmful, or illegal content
- Use the Service to harass, defraud, or harm others
- Resell or sublicense access without our written permission
6. Your Content
You retain ownership of photos and other materials you upload (“Your Content”). You grant us a limited license to store, process, display, transform, and transmit Your Content solely to provide the Service (including AI generation, cloud storage, history, and sharing). You represent that you have all rights necessary to grant this license.
7. AI-Generated Outputs
Designs, plant lists, and recommendations produced by our AI are provided for inspiration and planning purposes only. They are not professional horticultural, architectural, or engineering advice. Always verify plant suitability, building codes, and safety requirements with qualified professionals before making changes to your property. You are responsible for reviewing outputs before use.
8. Credits & Payments
The Service uses a credit system. 1 credit equals 1 AI garden visualization. Credits are purchased in packs described on the pricing page and may change with reasonable notice. As of the date above, illustrative packs are: Seed — 10 credits for 20 PLN; Grow — 30 credits for 45 PLN; Bloom — 40 credits for 50 PLN. Credits do not expire unless we clearly state otherwise at purchase.
Credit packs are one-time purchases, not subscriptions, unless we clearly present a different offer. Payments are processed by Stripe in PLN. Purchase grants the credits associated with your account subject to these Terms. We are not liable for loss of data caused by your failure to maintain backups outside the Service.
9. Intellectual Property
The Service, including its software, design, branding, and documentation, is owned by us or our licensors. These Terms do not grant you any rights to our trademarks or proprietary technology except as needed to use the Service.
10. Disclaimers
The Service is provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation. Automated design generation may produce unexpected results; you are responsible for reviewing outputs before use.
11. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for credits in the twelve months preceding the claim, or PLN 100 if you have not purchased credits.
12. Termination
You may close your account at any time by contacting us. We may suspend or terminate access if you violate these Terms or if required by law. Upon termination, your right to use the Service ends, and we may delete Your Content after a reasonable retention period. Unused credits have no cash value and are not refundable except where required by mandatory consumer law.
13. Governing Law
These Terms are governed by the laws of Poland. Disputes shall be subject to the exclusive jurisdiction of the courts of Poland, without prejudice to mandatory consumer rights under applicable EU law.
14. Changes
We may update these Terms from time to time. Material changes will be communicated via the Service or email. Continued use after changes take effect constitutes acceptance of the updated Terms.
